Welcome to BEAVERTEE.

These Terms of Use govern your access to and use of beavertee.com, including all information, content, features, tools, products and services available through this website (collectively, the “Services”).

Throughout these Terms, “we,” “us,” and “our” refer to BEAVERTEE. The terms “you” and “your” refer to any visitor, customer or other user of the Services.

By visiting our website, creating an account, submitting information or purchasing a product, you agree to be bound by these Terms of Use and all policies referenced herein. If you do not agree with these Terms, you should not access or use the Services.

1. ELIGIBILITY

By using the Services, you confirm that you are at least the age of majority in your state, province or country of residence, or that you have obtained permission from a parent or legal guardian.

You may not use our Services for any unlawful or unauthorized purpose or in any way that violates applicable laws or regulations.

2. OUR ONLINE STORE

Our store is hosted by Shopify, which provides the ecommerce platform that enables us to offer products and Services to you.

We may modify, suspend, update or discontinue any part of the website or Services when reasonably necessary. Product availability, features and website content may change without prior notice, subject to applicable law.

We do not guarantee that the website will always be available, uninterrupted, secure or free from errors.

3. PRODUCT INFORMATION

We make reasonable efforts to display product descriptions, materials, measurements, colors, photographs and other information as accurately as possible.

However, actual product colors may vary depending on:

  • Screen and device settings
  • Lighting conditions
  • Fabric texture
  • Product size
  • Print placement
  • Manufacturing tolerances

Many BEAVERTEE products are individually printed, cut or sewn. Minor differences in print placement, positioning, color or measurements may occur and do not necessarily indicate a manufacturing defect.

  • Product images may include digital mockups or styled photographs for presentation purposes. Customers should review the written product description, sizing information and customization details before placing an order.

4. PRICES AND PAYMENTS

All prices are displayed in the currency selected or shown at Checkout.

Prices, promotions, discounts and product availability may change without prior notice. However, changes will not normally affect an order already accepted by us unless an obvious pricing or technical error has occurred.

You agree to provide current, complete and accurate billing, payment and account information for all purchases.

By submitting an order, you authorize us and our payment providers to charge the selected payment method for:

  • The product price
  • Shipping charges
  • Applicable taxes
  • Customs or import charges collected at Checkout
  • Other charges clearly disclosed before purchase

We reserve the right to correct pricing, description or calculation errors. If an error affects an order you have placed, we will contact you when reasonably possible and may offer you the option to confirm the corrected order or receive a cancellation and refund.

5. ORDERS AND ORDER ACCEPTANCE

Submitting an order does not automatically guarantee acceptance.

We may accept, reject, limit or cancel an order for legitimate reasons, including:

  • Product unavailability
  • Incorrect product or pricing information
  • Payment authorization failure
  • Suspected fraud or unauthorized activity
  • Shipping restrictions
  • Incomplete customer information
  • Unlawful or infringing customization requests
  • Technical or system errors

An order is accepted when we send an order confirmation or begin processing or producing the order, depending on the circumstances.

If we cancel an order after payment has been collected, we will issue the applicable refund to the original payment method.

6. CUSTOM AND PERSONALIZED PRODUCTS

Customers may be able to submit names, text, numbers, photographs, logos, artwork or other content for customized products.

By submitting customization content, you confirm that:

  • The information you provide is accurate;
  • You own the submitted material or have permission to use it;
  • Its use does not infringe any copyright, trademark, privacy or other third-party right;
  • The material is not unlawful, abusive, defamatory, hateful or misleading;
  • BEAVERTEE may reproduce the material as necessary to fulfill your order.

You are responsible for reviewing all names, dates, numbers, spelling, sizes, colors, artwork and placement instructions before submitting or approving an order.

Once a customized product has entered production, it may not be possible to change or cancel the order.

We reserve the right to refuse any custom request that we reasonably believe may violate applicable law, these Terms or another party’s rights.

7. DESIGN APPROVAL

If we provide a design proof or preview, you are responsible for reviewing it carefully before approval.

Your approval confirms your acceptance of the visible:

  • Text and spelling
  • Names and numbers
  • Colors
  • Artwork
  • Design placement
  • Product style
  • Other customization details

Digital previews may not represent exact physical colors because displays and printed fabrics reproduce color differently.

After you approve a design, changes may result in additional fees or production delays. If production has already started, requested changes may not be possible.

8. SHIPPING AND DELIVERY

Orders may be fulfilled from our United States warehouse or our production and fulfillment facility in Vietnam, depending on product availability, customization requirements and delivery destination.

Estimated delivery times are:

  • US warehouse: 3–5 business days
  • Vietnam facility: 6–10 business days

These estimates generally apply after order processing or production has been completed and the package has been transferred to the carrier.

Delivery dates are estimates and are not guaranteed. Delays may occur because of weather, customs, carrier operations, holidays, incorrect addresses or circumstances outside our reasonable control.

9. INTERNATIONAL ORDERS

International orders may be subject to customs inspections, import duties, taxes or other charges imposed by the destination country.

Unless such charges are collected at Checkout or otherwise expressly stated, the customer is responsible for applicable import duties, taxes and customs fees.

Customs procedures may delay delivery. BEAVERTEE does not control the decisions or processing times of customs authorities.

10. SHIPPING ADDRESSES

You are responsible for providing a complete and accurate shipping address.

If you need to change an address, contact us as soon as possible. We cannot guarantee an address change after the order has entered production or been transferred to the carrier.

Customers may be responsible for additional shipping costs when a package is returned, redirected or reshipped because of:

  • An incorrect or incomplete address
  • An unavailable recipient
  • Refusal to accept delivery
  • Failure to collect the package

  • Unpaid customs charges

11. RETURNS, EXCHANGES AND REFUNDS

Returns, exchanges and refunds are governed by our Refund Policy.

Eligibility may depend on the product type, reason for return, product condition and time elapsed since delivery.

Customized, personalized or made-to-order products may not be eligible for return or exchange unless they arrive damaged, defective or materially different from the approved order.

Nothing in these Terms limits any mandatory consumer rights available under applicable law.

12. ACCOUNTS AND ACCOUNT SECURITY

You may need to create an account to access certain features.

You are responsible for:

  • Providing accurate account information
  • Maintaining the confidentiality of your password
  • Restricting unauthorized access to your account
  • Informing us promptly of suspected unauthorized use

You are responsible for activity conducted through your account unless caused by circumstances for which you are not legally responsible.

We may restrict or terminate an account that is used fraudulently, unlawfully or in violation of these Terms.

13. CUSTOMER REVIEWS AND USER CONTENT

You may be able to submit reviews, photographs, comments, feedback, suggestions or other content.

You retain ownership of content you submit. However, by submitting it to us, you grant BEAVERTEE a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, display and distribute that content for operating, improving and promoting the Services, to the extent permitted by applicable law.

You confirm that your submitted content:

  • Is accurate and based on your genuine experience;
  • Does not violate another person’s rights;
  • Does not contain unlawful, abusive or misleading material;
  • Does not contain malicious software or harmful code;
  • Does not impersonate another person.

We may moderate or remove user content that violates these Terms or applicable law.

14. INTELLECTUAL PROPERTY

Unless otherwise stated, the website and its original content are owned by or licensed to BEAVERTEE and are protected by applicable intellectual property laws.

Protected materials may include:

  • The BEAVERTEE name and branding
  • Logos and graphic elements
  • Original apparel designs and patterns
  • Product photographs and videos
  • Website graphics and layouts
  • Product descriptions and written content
  • Marketing materials
  • Custom design presentations

You may access and view website content for personal, noncommercial use.

You may not reproduce, modify, distribute, publish, sell, license, scrape or commercially exploit protected content without prior written authorization from BEAVERTEE or the applicable rights holder.

15. THIRD-PARTY INTELLECTUAL PROPERTY

Third-party names, logos, trademarks and other intellectual property remain the property of their respective owners.

Their appearance on the website does not necessarily indicate sponsorship, partnership or endorsement.

Customers submitting third-party materials for customization are responsible for obtaining all necessary permissions and authorizations.

16. PROHIBITED USES

You may not use the website or Services:

  • For any unlawful or fraudulent purpose;
  • To violate applicable laws or regulations;
  • To infringe intellectual property or privacy rights;
  • To submit false, misleading or unauthorized information;

Such tools are provided on an “as available” basis. To the extent permitted by law, we make no separate warranties regarding third-party tools.

Your use of optional tools is voluntary and subject to the applicable third-party provider’s terms.

Our collection, use and disclosure of personal information are governed by our Privacy Policy.

By using the Services, you acknowledge that personal information may be processed as described in that policy, including by Shopify and service providers supporting payments, analytics, customer service, fulfillment and shipping.

20. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by applicable law, the website and Services are provided on an “as is” and “as available” basis.

We do not guarantee that:

  • The Services will always be uninterrupted or error-free;
  • Website information will always be complete or current;
  • Every product will remain available;
  • Defects or technical issues will always be corrected immediately;
  • The website will be free from all harmful components.

This disclaimer does not affect warranties or consumer protections that cannot legally be excluded.

21. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, BEAVERTEE and its owners, officers, employees, affiliates, agents, contractors and service providers will not be liable for indirect, incidental, special, punitive or consequential losses arising from your use of or inability to use the Services.

Nothing in these Terms excludes or limits liability that cannot legally be excluded, including applicable liability for fraud, willful misconduct or mandatory consumer protections.

Where liability cannot be fully excluded, it will be limited to the maximum extent permitted by applicable law.

22. INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless BEAVERTEE, its affiliates, owners, officers, employees, agents, contractors and service providers from claims, liabilities, damages and reasonable expenses arising from:

  • Your material violation of these Terms;
  • Your unlawful use of the Services;
  • Content or materials you submit;
  • Your infringement of another party’s rights;
  • Fraudulent or unauthorized activity attributable to you.

This section does not apply where prohibited by applicable consumer law.

23. SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law.

The remaining provisions will continue in full force and effect.

24. WAIVER

Our failure to enforce a provision of these Terms does not constitute a waiver of that provision or any other right.

Any waiver must be made in writing by an authorized representative of BEAVERTEE.

25. ENTIRE AGREEMENT

These Terms, together with the policies referenced herein, constitute the agreement between you and BEAVERTEE regarding your use of the Services.
